Social Optics Inc. (“us”, “we”, or “our”) operates https://www.mysocialoptics.com/ and Social Optics mobile application (hereinafter referred to as “Service”).

Our Privacy Policy governs your visit to https://www.mysocialoptics.com/ and Social Optics mobile application, and explains how we collect, safeguard and disclose information that results from your use of our Service.

We use your data to provide and improve Service. By using Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Our Terms and Conditions (“Terms”) govern all use of our Service and together with the Privacy Policy constitutes your agreement with us (“agreement”).


2. Definitions

PERSONAL DATA means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).

THE USER is the individual using our Service. The User corresponds to the Data Subject, who is the subject of Personal Data.

We also collect personal information when your school or district creates accounts for administrators, teachers, and students. Social Optics endeavors to only collect information that is relevant and not excessive for the purposes for which it is to be processed. Personal information includes information that can identify you, as well as indirect identifiers, such as IP address or other unique identifiers, where such information can be used to identify you individually, and any other information deemed personal information under applicable law.

For teachers or administrators, this includes information such as full name, e-mail address, and school. For students, this includes information such as full name, student number, and school. If the school or district elects to do so, additional optional data may be entered for students that may include demographic data such as gender, birth date, ethnicity, special education, instructional language, participation in free lunch programs, and Title 1 status.

This information is only used by Social Optics for the purpose of completing the purpose for which provided. Data generated through the use of the Service or mobile application from which personal information and attributes about any user has been removed (“de-identified data”), may be used by Social Optics for lawful purposes, including, without limitation, product and service improvement or development, general product and service analysis, benchmarking, development of best practices, and/or educational research or statistical assessment.

Personal Data
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:

We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. We may use and store information about your location if you give us permission to do so (“Location Data”). We use this data to provide features of our Service, to improve and customize our Service.

You can enable or disable location services when you use our Service at any time by way of your device settings.

We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

We may disclose personal information that we collect, or you provide:

Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities.

If we or our subsidiaries are involved in a merger, acquisition or asset sale, your Personal Data may be transferred.

11. Your Data Protection Rights under the California Privacy Protection Act (CalOPPA)

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. According to CalOPPA we agree to the following:

(b) our Privacy Policy link includes the word “Privacy”, and can easily be found on the page specified above on the home page of our website;

(c) users will be notified of any privacy policy changes on our Privacy Policy Page;

Our Policy on “Do Not Track” Signals:

We honor Do Not Track signals and do not track, plant cookies, or use advertising when a Do Not Track browser mechanism is in place. Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

If you choose to delete your personal information, you may not be able to use certain functions that require your personal information to operate.

(c) To stop selling your personal information. We do not sell your personal information for monetary consideration. However, under some circumstances, a transfer of personal information to a third party, or within our family of companies, without monetary consideration may be considered a “sale” under California law.

If you submit a request to stop selling your personal information, we will stop making such transfers. If you are a California resident, to opt-out of the sale of your personal information, click “Do Not Sell My Personal Information” at the bottom of our home page to submit your request.

Please note, if you ask us to delete or stop selling your data, it may impact your experience with us, and you may not be able to participate in certain programs or membership services which require the usage of your personal information to function. But in no circumstances, we will discriminate against you for exercising your rights.

Social Optics Inc. uses remarketing services to advertise on third party websites to you after you visited our Service. We and our third-party vendors use cookies to inform, optimise and serve ads based on your past visits to our Service.

We may provide paid products and/or services within Service. In that case, we use third-party services for payment processing (e.g. payment processors).

We will not store or collect your payment card details. 19. Children's Privacy

Our Services may be used by children under the age of 13 (“Children”).

What information is collected online from children under 13?

Children under 13 access Social Optics using a student account. Typically, these accounts are established by the student’s school or by Social Optics using information provided by the school. The minimum information required to create a student account is:


  • First Name

  • Last Name

  • Email

  • District ID

Other data fields we store are:


  • Middle name (optional)

  • Student courses

  • Student course variantStudent course/module scores and progress

  • Student classes

  • Student sections

  • Student metadata

Some of our products may include exercises that utilize Speech Recognition Engine (SRE) functionality within the program. For products with SRE exercises, in certain activities and specific points within the program, the learner is prompted to produce or repeat words or phrases into the learner’s computer or mobile device microphone. The SRE automatically converts the recorded spoken word or phrase into an individual SRE pronunciation file (or “Sound Log”) for that specific activity, which are used to measure the learner’s fidelity for individual word or phrase production in the exercise and progress within the program. Sound Logs may be retained and analyzed (either by machine or human analysis) and used to provision and support our services to the learner/customer, to help us to develop and improve the quality of our products, program exercises, and the SRE, and for internal research purposes. Sound Logs are never used as a means to identify any individual learner or user.

Do you obtain parental consent prior to collecting information from the child?

No. Student accounts are typically created by teachers or school administrators, or by Social Optics using information provided by the school. COPPA and other laws authorize schools to act in place of the parent or guardian in deciding whether to give consent to the collection and use of student information for educational purposes. By creating the student account on the Service, teachers provide consent and authorization for Social Optics to store and process personal data about those children for the purpose of providing the Social Optics program. Children under 13 cannot create their own accounts and parents do not have access to the administrative portion of our Service where student accounts are created.

Do you agree to comply with the Family Educational Rights and Privacy Act of 1974, as amended (“FERPA”), and applicable state student records privacy laws?

Yes. When we receive or access student personal data and education records from our school and district customers through their use of our products and services, we understand that we are acting in the capacity of a “school official” under FERPA, and are committed to complying with the limitations and requirements imposed on us as an educational service provider to our school and district customers under FERPA and other applicable state student records privacy laws. Student personal data is used only for the purpose of fulfilling our duties and provisioning our products and services under our services agreement with our school and district customer, and is not otherwise used or disclosed except as provided for in the service agreement, as required by law, or as authorized or directed in writing by our school or district customer.

Can a child enter personal information into your Service?

No. Personal information about children can only be entered by school personnel or by Social Optics personnel acting on their behalf. Students using the Social Optics program are not able to enter or store additional personal information on our Service. The Social Optics program collects and stores data created by student use of the program (namely, performance and progress data), which is linked to each student’s respective personal information.

Is a child’s personal information required for participation in the Social Optics program?

Yes. Students need individual accounts to access the Social Optics program so that their progress in the software program can be monitored by the school and its teachers.

Is children’s information shared with unrelated third parties?

No. Personal information obtained online from students is not released to any unrelated third party except as permitted by law or as expressly set forth in this policy (such as to certain Affiliated Businesses, as provided below), or at the direction of the school.

What are the choices of a parent or guardian?

Social Optics collects information under the direction of its Clients (school personnel or administrators of the Social Optics product), and has no direct relationship with the individuals whose personal data it processes. If you are a parent or guardian or otherwise a customer of one of our Clients and would no longer like to be contacted by one of our Clients that use our service, please contact the Client that you interact with directly. Service providers that we utilize to provision our products and services, and who may access or receive personal information to provide those services or functionality, are under contractual obligations with respect to the personal information and are covered by the service agreements with our Clients.
Parents and legal guardians can make choices regarding the personal information we store online for their children by contacting their child’s school to review what personal information is being collected. Parents who experience difficulty or require additional information may contact Social Optics directly, however, parents should start by contacting the school first since the school is the entity that contracted with Social Optics for the services and authorized the information to be collected and stored. In addition, the child’s school is in best position to verify the parent’s identity and connection to the student, which would be necessary before Social Optics could respond to this type of request.
Upon written request from the school, or from a confirmed parent or legal guardian (as noted above), Social Optics will provide an inventory of the personal information it holds on their behalf and take reasonable steps to allow such persons to review their information for the purposes of correction or removal, subject to limitations under applicable law. We will respond to all inquiries within 30 days of receipt. Please see the contact information provided at the end of this privacy policy to contact us.

20. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

We will update “effective date” at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
